On October 20, 2026, Alabama Governor Kay Ivey granted clemency to death row prisoner Toforest Johnson (pictured, center), commuting his sentence to life without parole. Mr. Johnson has maintained his innocence in the 1995 death of Jefferson County Deputy Sheriff William Hardy. His case gained notoriety as the subject of the award-winning podcast Earwitness.

“When presented with Mr. Johnson’s case, I had concerns there was not enough direct evidence to carry out the most serious punishment, death,” Gov. Ivey said in a statement. “My decision is not a determination of innocence, but a recognition that the circumstances of this case justify commuting his death sentence to life imprisonment, without possibility of parole.”

In response to Gov. Ivey's commutation, Ty Alper, one of Mr. Johnson's attorneys, said in a [statement](https://docs.google.com/document/d/1h3NLrFalGjAxqKf07uhS_SNTNlXonQdeJ5WqPsq_dz4/edit?tab=t.0), “We are grateful to Governor Ivey for diligently reviewing Toforest’s case and taking action to spare an innocent man from execution. This significant milestone was made possible by Alabamians from all sectors of society united in their belief that Toforest does not belong on death row. That list now includes Governor Ivey. Toforest Johnson is innocent. Now it is up to the courts to overturn his conviction and grant him a new trial. We will keep fighting until he is home with his family.”

This is the third time Gov. Ivey has commuted a death sentence, and the fourth death row commutation in Alabama in the modern era.
