Citing Vindictive Prosecution, El Paso Judge Dismisses Capital Murder Case
A Texas trial judge has dismissed all charges against an El Paso murder defendant, saying that the decision to seek the death penalty against him was a product of “prosecutorial vindictiveness.” In an order issued December 14, 2021, District Court Judge Alyssa Perez (pictured) freed Ivan Gabaldon, dismissing his case with prejudice.
