The January 1, 2023 report includes the following statistics:

The number of prisoners on death rows or facing capital retrials or resentencings across the nation was 2,331, a decrease of 32 from October 1, 2022. It was down by 105 (4.3%) from the 2,436 reported on January 1, 2022. The convictions or death sentences of 217 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process. That left 2,114 prisoners facing active death sentences, a decrease of 61 from the quarter before. 34.9% of those on U.S. death row (832 prisoners) were in states with moratoria on executions. There were 1,367 prisoners in 23 states, or 58% of death row, with death sentences LDF classified as active and enforceable.

The October 1, 2022 report includes the following statistics:

The number of prisoners on death rows or facing capital retrials or resentencings across the nation was 2,363, a decrease of 31 from July 1, 2022. It was down by 92 (3.7%) from the 2,455 reported on October 1, 2021. The convictions or death sentences of 188 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process. That left 2,175 prisoners facing active death sentences, a decrease of 24 from the quarter before. 36.2% of those on U.S. death row (855 prisoners) were in states with moratoria on executions. There were 1,385 prisoners in 23 states, or 58% of death row, with death sentences LDF classified as active and enforceable.

The number of prisoners on death rows or facing capital retrials or resentencings across the nation was 2,394, a decrease of 20 from April 1, 2022. It was down by 80 (3.2%) from the 2,474 reported on July 1, 2021. The convictions or death sentences of 195 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process. That left 2,199 prisoners facing active death sentences, a decrease of 9 from the quarter before. 36.6% of those on U.S. death row (876 prisoners) were in states with moratoria on executions. There were 1,373 prisoners in 23 states, or 57% of death row, with death sentences LDF classified as active and enforceable.

The number of prisoners on death rows or facing capital retrials or resentencings across the nation was 2,414, a decrease of 22 from January 1, 2022. It was down by 90 (3.6%) from the 2,504 reported on April 1, 2021. The convictions or death sentences of 206 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process. That left 2,208 prisoners facing active death sentences, a decrease of 10 from the quarter before. 36.6% of those on U.S. death row (883 prisoners) were in states with moratoria on executions. There were 1,376 prisoners in 23 states, or 57% of death row, with death sentences LDF classified as active and enforceable.

It was down by 98 (3.8%) from the 2,553 reported on October 1, 2020. The convictions or death sentences of 219 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process. That left 2,236 prisoners facing active death sentences, a decrease of 90 (3.8%) from a year before. 36.4% of those on U.S. death row (894 prisoners) were in states with moratoria on executions. It was down by 117 (4.5%) from the 2,591 reported on July 1, 2020. The convictions or death sentences of 229 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process. That left 2,245 prisoners facing active death sentences, a decrease of 36 from the previous quarter. 34% of those on U.S. death row (853 prisoners) were in states with moratoria on executions. That left 1,440 prisoners in 24 states, or 58% of death row, with death sentences LDF classified as active and enforceable.

It was down by 99 (3.8%) from the 2,603 reported on April 1, 2020. The convictions or death sentences of 223 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process. That left 2,281 prisoners facing active death sentences, a decrease of 25 from the previous quarter, and down 92 (3.9%) from the 2,373 prisoners facing active death sentences on April 1, 2010. 34.4% of those on U.S. death row (861 prisoners) were in states with moratoria on executions, a decrease of 6 from the previous quarter. That left 1,468 prisoners in 25 states, or 58.6% of death row, with death sentences LDF classified as active and enforceable.

The number of prisoners on death rows across the nation was 2,620, a decrease of 19 from October 1, 2019 and 70 (2.6%) from the 2,690 reported on January 1, 2019. The convictions or death sentences of 240 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process, meaning 2,380 prisoners were facing active death sentences, a decrease of 27 over the previous quarter, and down 74 (3.0%) from the 2,454 prisoners facing active death sentences at the beginning on 2019. 34.6% of those on U.S. death row (906 prisoners) were in states with moratoria on executions. The percentage was unchanged from the previous quarter, though the number was down by seven.

The number of prisoners on death rows across the nation was 2,639, a decrease of 17 from July 1, 2019 and 82 (3.0%) from the 2,721 reported on October 1, 2018 — coincidentally the exact same declines as in the previous quarter. The convictions or death sentences of 232 death-row prisoners had been reversed pending retrial, resentencing, or completion of the appeals process, meaning 2,407 prisoners were facing active death sentences, a decrease of 13 over the previous quarter. 34.6% of those on U.S. death row (913 prisoners) were in states with moratoria on executions.
