The U.S. District Court for the Middle District of Alabama had issued a pre­lim­i­nary injunc­tion on September 19, 2022 enjoin­ing Alabama from exe­cut­ing Alan Eugene Miller by any method oth­er than nitro­gen hypox­ia. On the after­noon of September 22, 2022, a pan­el of the U.S. Court of Appeals for the Eleventh Circuit by a 2 – 1 vote denied the motion to stay injunc­tion filed by the state attor­ney gen­er­al. At about 9:15 p.m. Central time, the Supreme Court VACATED THE INJUNCTION with­out opin­ion by a 5 – 4 vote, leav­ingg Alabama approx­i­mate­ly 2½ hours to car­ry out the exe­cu­tion before the warrant expired.
